This working paper, prepared by IR Share, investigates the practical implementation of the European Works Council (EWC) Directive at company level. Using case studies, it examines the extent to which such effective collaboration has gone beyond the EWC Directive’s requirements to establish joint work on other issues of common concern.

Telework and right to disconnect

Workshop on 1 December 2022

The workshop is organised as part of the Study exploring the social, economic and legal context and trends of telework and the right to disconnect. It is led by Visionary Analytics, Notus. The study is carried out at the request of the DG for Employment, Social Affairs and Inclusion. IR Share carried out the French part of the study.

Telework

EU-OSHA: Telework and health risks in the context of the COVID-19 pandemic: evidence from the field and policy implications

This report reviews the occupational safety and health issues associated with telework, and the measures and regulations in place to prevent and manage them. In-depth, candid interviews with workers and employers in three selected countries highlight the positive and negative impacts of teleworking during the pandemic. IR Share provided the French field study.

Restitution of the ISA project

Monday 29 March at 17:30 (Paris/Brussels time) from 17:30 to 19:00

As  French partner of the ISA project, we are organising a short restitution of the project on Monday 29 March at 17.30 with  Feliciano Iudicone, researcher at the Brodolini Foundation, on the theme "Is the cooperation between public authorities and sectoral funds effective in the fight against fraudulent posting of workers in the EU?. We also welcome Giacomo Virgilio from CISL.

The objectives of the ISA project are to promote and strengthen transnational cooperation between authorities and stakeholders involved in the posting of workers in the construction sector, by promoting the establishment of information-sharing agreements to monitor and facilitate the posting of workers.

Report on the Social Services Workforce in Europe: Current State of Play and Challenge

The main objectives of this report, carried out by IR Share, is to provide precise data on the sector’s workforce and challenges.  The report shows that the social services sector employed more than 10.9 million people in 2018 in the EU, representing 4.7% of the total EU labour force.

EWC 4.0: the role of European Works Councils in the digitalisation era

Pequenos manual de usuario para los actores del dialogo social europeo en las empresas.

Este documento pretende extraer lecciones de varios talleres en 2018 y 2019 en los que participarán diversas partes interesadas de los comités de empresa europeos y de los comités de empresa europeos, representantes tanto de la dirección como de los trabajadores, de diversos sectores y países de origen. Sólo pretende ser un punto de partida no partidista para que los actores de los comités de empresa euro- peos en su diversidad inicien una reflexión lo más abierta posible sobre el papel de su autoridad en la actual y futura revolución digital dentro de las empresas. Por lo tanto, esperamos que sea capaz de cumplir esta tarea en apoyo del desarrollo de un diálogo empresarial europeo económicamente eficiente y socialmente responsable.

European Industrial Relations Dictionary

In association with ASTREES, IR Share produced a number of new entries in the European Industrial Relations Dictionary published on line by the European Foundation for the Improvement of Living and Working Conditions.

We either updated or created the following entries in the European Industrial Relations Dictionary: Annual leave, Information and Consultation, Discrimination on the ground of belief, European Globalisation adjustment Fund, Global union network, Global works council, Right to strike in civil aviation, Right to switch off, Social scoreboard, Strike action at EU level, Whistleblower protection, Work-life balance directive and also Written Statement Directive

Study on employment and working conditions in social services

Within the framework of the PESSIS+ European project, on the basis of an invitation to tender, the Federation of European Social Employers selected IR Share to perform a study looking at employment and working conditions in social services in Europe.

The study (not yet published), was presented in June 2019 to the industry’s social partners, and to the European Economic and Social Committee, in Brussels. As a follow-on from the report on ‘The Social Services Workforce in Europe: Current State of Play and Challenges’, IR Share also helped to set up a Social Employers Observatory to analyse employment and good practice (see FESE press release).

Sector-based global economic and social monitoring

In conjunction with its partner Trendeo, IR Share worked with a number of European Works Councils to monitor worldwide investments in their own particular sector of activity and to present this data to them.

The data presented show which companies are investing, in which countries and in which technologies and also include the sums of money invested and the number of jobs involved. All of which is extremely useful for discussions on their company’s strategy! The data also include initiatives in the social field (collective bargaining, industrial disputes, transnational agreements, etc.) in that particular sector. We made presentations for the Renaut Group Works Council and Engie's EWC (photo).

Obstacles faced by women entrepreneurs

IR Share was one of the parties involved in producing the report on “Female entrepreneurship: Public and private funding“, published by EUROFOUND on 19 December 2019.

Women entrepreneurs represent only a small proportion of the total number of entrepreneurs active in the European Union today. Some of the obstacles facing established and aspiring women entrepreneurs include securing adequate funding, gaining access to the right networks and seeking appropriate information and advice.

CFE-CGC Métallurgie congress

At its congress held in Troyes, in June 2019, the CFE-CGC Métallurgie federation asked Frédéric Turlan, head of IR Share, to chair a round-table discussion with European and international trade union representatives.

The exchanges highlighted the benefits that the IndustriAll Europe and IndustriAll Global Union trade union federations, whose remit is European and global in scope respectively, could offer to CFE-CGC Métallurgie, and in return what the federation, whose remit primarily covers managerial staff, could offer to these two international organisations.

Annual meeting of Eurofound correspondents

On 4 and 5 April 2019, IR Share and its partner ASTREES took part in the annual meeting of correspondents of the European Foundation for the Improvement of Living and Working Conditions (Eurofound), in Dublin.

Study concerning EWCs and digitisation

European Commission agrees to fund work on European Works Councils and digitisation.

The funding application made by the Astrees-IR Share consortium to the European Commission, for a study concerning EWCs and the development of social dialogue in transnational companies about the impact of digitisation, was accepted on 16 November 2017. This initiative is funded as part of budget heading VP/2017/008, and is supported by the trade union federation CEC-European Managers.

IR Share wins tender to be Eurofound's correspondent for France

IR Share, in a consortium with Astrees, was announced on 31 October 2017 as winner of the tender to be the France correspondent for the European Foundation for the Improvement of Living and Working Conditions (Eurofound)

IR Share has been Eurofound's France correspondent since 2010. In 2013, it won the tender to be correspondent for 2014-2018, and its work has once again been rewarded.

IR Studies: Post-Lab Project

Developing experiences of administrative cooperation in the framework of the posting of workers

Post-Lab (Developing experiences of administrative cooperation in the framework of the posting of workers) is a EU-funded transnational project, aiming at fostering administrative cooperation between public authorities and social partners in the field of posting of workers in the construction sector. IR Share has contributed to this project. In a view to contribute fighting such abuses, the Post-Lab project addresses administrative cooperation and information sharing as the key to ease compliance with rules on posting in the construction sector. This includes not only dissuasive measures, such as those easing the detection of frauds and the enforcement of posted workers’ rights, but also preventive actions, such as those simplifying posting procedures for companies or making relevant information easily accessible to them.

IR Share participates in a project on integrating certain categories of people into the labour market

In November 2017, IR Share was chosen as the national expert for France, for a study commissioned from the Institute for Employment Studies (IES) by the JP Morgan Chase Foundation.

The study will cover the integration of certain target groups (unskilled young people, migrants, older workers) into the labour market, how they can be attracted towards specific sectors and how they can be re-skilled to maintain their employability in the context of an increasingly digital economy.

First cycle of training for Veolia's EWC is completed

A focus on the use of strategic data by the EWC

On 17 and 18 October 2017, IR Share and Astrees provided training for the last group of members from Veolia's European Group Works Council, covering the diverse systems of industrial relations in Europe, the main provisions of directive 2009/38 and of the European EWC agreement, and also the use of strategic data released by the group's management.

A study of fraud related to secondment

IR Share submitted a report in July 2017 on fraud related to intra-company transfer in France

This report was produced as part of a project funded by the European Foundation for the Improvement of Living and Working Conditions (Eurofound) and entitled "Sectoral aspects of fraudulent forms of contracting work and self-employment in Europe". This project was implemented by the Austrian research institute FORBA as part of a consortium with the Spanish company Notus.

IR Share trains the Thales European Works Council in social protection in Europe

IR Share organised a training course on 30 and 31 May for members of the Thales EWC, on social protection in Europe

The speakers dealt with the origins of the differences in the cost of labour in the EU, and the different pension, unemployment and health insurance systems in the EU. The course ended with a lecture given by Bruno Palier, professor at Sciences Po, CNRS Research Director at the Centre d'Études Européennes and co-director of the LIEPP, on welfare reforms in the EU.

IR Share trains members of Veolia's European Group Works Council

IR Share and Astrees provided training for a group of members from Veolia's European GWC on 3 and 4 May 2017

The training concerned the diverse systems of industrial relations in Europe, the main provisions of directive 2009/38 and of the European GWC agreement, and also the use of strategic data released by the group's management.

IR Share trains members of the Common European Companies' Committee (CCSE) of Scor SE

IR Share and Astrees organised training on 1 and 2 March 2017 for members of the CCSE of French reinsurance group Scor

The course enabled the members to understand their agreement in the light of European legislation, to take greater account of the diverse models of industrial relations that exist within the European Union in the operation of the council, and to develop an action plan for the mandate of the CCSE.

IR Share contributes to a study on the development of employers' alliances

Case study conducted in two regions of France

IR Share took part in a study, for the European Foundation for the Improvement of Living and Working Conditions (Eurofound), on the employers' alliances in the Poitou-Charentes and Languedoc-Roussillon regions of France, coordinated by the Public Policy and Management Institute (Lithuania). The case studies were incorporated in "New forms of employment: Developing the potential of strategic employee sharing", a report published on 21 November 2016.

IR Share is a partner in a study of the action taken by the social partners in the construction sector in connection with the posting of workers

Comparative study of the experience gathered from cooperation between administrative authorities and/or social partners

IR Share is a partner in the Post-Lab European project, led by the Italian paritarian institution responsible for the management of paid leave and Christmas bonuses for employees in the construction industry (Commissione Nazionale Casse Edili - CNCE) and coordinated by the Fondazione Giacomo Brodolini. The project's aim is to analyse the measures taken by the social partners in the construction sector in several EU countries, in particular to combat fraud relating to worker posting and to guarantee employees' rights.

IR Share collaborates in evaluation study of European Globalisation Adjustment Fund

Three case studies of requests for assistance from France

IR Share has taken part, for France, in the evaluation of the activities of the European Globalisation Adjustment Fund - EGF undertaken for the European Commission by the consultancy ICF. In this connection, IR Share completed three case studies of the dossiers submitted by France for PSA Peugeot-Citroën, GAD and Mory Global.

IR Share contributes to evaluation of directive on European works councils

Qualitative interviews at ten French groups

On behalf of the European Commission, IR Share took part in 2016 in the evaluation of the application of directive 2009/38 on European works councils undertaken by the consultancy ICF. IR Share conducted interviews at 10 groups in France that put in place or renegotiated an EWC agreement on the basis of directive 2009/38. The report is pending publication (February 2017).

IR Share takes part in research on extending working lives through flexible retirement schemes

IR Share was selected by the European Foundation for the Improvement of Living and Working Conditions (Eurofound) to undertake a study of flexible retirement arrangements in France, with a particular focus on the phased retirement scheme. Hans Dubois, who led the research, granted us an interview.

IR Share and Astrées provide training for members of the European works council at Suez

IR Share and Astrees in September 2016 organised a training event for half the members of the European works council of Suez, focusing on the different systems of industrial relations in Europe, European social legislation, and the systems for retirement and for managing occupational diseases in the EU.

IR Share and Astrees in July and September organised two 2-day training events for the members of the Atos SE works council, focusing on the different systems of industrial relations in Europe, understanding the directive on worker involvement in the European Company (SE) and the agreement on the Atos SE works council.

IR Share and Astrées carry out training on industrial relations for the European works council at Veolia

Diversity of national models and European social legislation

IR Share and Astrees on 12-13 May 2016 organised a 2-day training cycle for the members of the Veolia group's European works council on the diversity of industrial relations models and the role of the EWC. The aim was also to improve the contact between the group's European works council and the national social dialogue bodies.

IR Share organises the first training programme for Eurotunnel SE works council

Marked interest among British delegates in information and consultation rights

IR Share in April 2016 organised training for the British and French members of the SE works council of the Eurotunnel group together with the Institute for Employment Studies. The training examined British and French industrial relations systems, as well as the role of the works council. The British delegates fully appreciated what the SE works council's right to information and consultation could mean for them.

IR Share y Astrees impartieron a la dirección del comité de empresa europeo de Veolia una formación de tres días sobre los distintos modelos de relaciones laborales y sobre el papel de los comités de empresa europeos.

IR Share y Astrees imparten formación a los miembros del comité de empresa europeo de BNP Paribas

IR Share y Astrees organizaron dos jornadas formativas para los miembros del CEE del grupo BNP Paribas.

La formación tuvo lugar en Louveciennes (Francia) el 29 y 30 de octubre 2014 bajo la batuta de Christophe Teissier (Astrees), Sebastian Schulze-Marmeling (Astrees) y Frédéric Turlan (IR Share). Las jornadas se centraron en el acuerdo CEE, su relación con las delegaciones nacionales y el papel del CEE en las negociaciones transnacionales.

IR Share y Astrees imparten formación a los miembros del comité de empresa europeo de Sanofi

IR Share y Astrees organizaron del 17 al 19 de junio tres jornadas formativas para los miembros del CEE del grupo Sanofi.

La formación tuvo lugar en Madrid entre los días 17 y 19 de junio de 2014 bajo la batuta de Christophe Teissier (Astrees), Claude-Emmanuel Triomphe (Astrees) y Frédéric Turlan (IR Share). Las jornadas se centraron en el acuerdo CEE, los modelos de relaciones laborales en los distintos países, el papel de los miembros del CEE y su relación con las delegaciones nacionales y el papel del CEE en las negociaciones transnacionales. Amaia Otaegui Jáuregui, de la Fundación 1º de Mayo, ofreció asimismo una panorámica de las relaciones laborales en el país anfitrión, España.

Estudios de casos sobre las nuevas formas de empleo

IR Share ha colaborado con el Public Policy and Management Institute de Lituania en la realización de estudios de casos sobre las "nuevas formas" de empleo en Francia y en Luxemburgo.

En el caso de Francia, se han estudiado las agrupaciones de empresarios y las nuevas sociedades de porte salarial (portage salarial); en Luxemburgo, el estudio se ha centrado en la cesión de mano de obra. Estos estudios de casos se enmarcan dentro de una investigación que se está llevando a cabo por encargo de la Fundación Europea para la Mejora de las Condiciones de Vida y Trabajo y que todavía no se ha publicado.

IR Share remporte plusieurs appels d'offres de la Fondation de Dublin

Comme en 2009, IR Share a remporté les appels d'offres pour être le correspondant de la Fondation européenne pour l'amélioration des conditions de vie et de travail (Eurofound) pour la France et le Luxembourg.

IR Share est confirmé comme correspondant pour l'Union européenne, en consortium avec l'Institute for Employment Studies (IES). IR Share est aussi confirmé comme correspondant pour la France et, cette fois en consortium avec le CEPS, pour le Luxembourg. L'équipe formée par IR Share en consortium avec Institute for the Study of Societies and Knowledge (ISSK) a aussi été retenue pour être le correspondant de la Fondation en Bulgarie.

IR Share hat bei mehreren Auswahlverfahren von Eurofound (Dublin) den Zuschlag erhalten

IR Share ist im Konsortium mit dem Institute for Employment Studies (IES) als Korrespondent für die Europäische Union bestätigt worden. Außerdem ist IR Share als Korrespondent für Frankreich und diesmal im Konsortium mit CEPS für Luxemburg bestätigt worden. Im Konsortium mit dem Institute for the Study of Societies and Knowledge (ISSK) ist IR Share zudem als Korrespondent der Stiftung in Bulgarien berücksichtigt worden.

Un estudio de casos sobre el papel y los métodos de trabajo del Fond paritaire de sécurisation des parcours professionnels

IR Share ha sido el socio francés de la fundación Fondazione Giacomo Brocolini en la realización de un estudio de casos sobre el papel y los métodos de trabajo del Fond paritaire de sécurisation des parcours professionnels.

El 17 de junio de 2013 se celebró una reunión en las oficinas del FPSPP (fondo paritario de garantía de los itinerarios profesionales) para conocer mejor la organización paritaria de la formación profesional en Francia con el fin de poder asesorar al ministerio de trabajo italiano ante una posible reforma de la formación profesional.

Seminario de formación anual del comité de empresa europeo del Grupo Carrefour

Con ocasión del seminario de formación anual del comité de empresa europeo del Grupo Carrefour, IR Share realizó una presentación sobre el impacto de la crisis económica en las relaciones laborales en la Unión Europea.

Con ocasión del seminario de formación anual del comité de empresa europeo del Grupo Carrefour, IR Share realizó una presentación sobre el impacto de la crisis económica en las relaciones laborales en la Unión Europea centrándose especialmente en los países en los que le Grupo está más representado. “Se realizó una amplia exposición de la evolución legislativa tanto a nivel europeo como en los distintos países que tuvo muy buena acogida entre los participantes por su claridad y objetividad; a la vicesecretaria del comité de empresa europeo le pareció una información realmente útil”, dijo Mathilde Tabary, directora del área de desarrollo social y responsabilidad social corporativa (CSR) de Carrefour tras la segunda y última jornada del seminario.

 

IR Share y Astrees organizan la formación de los miembros del comité de empresa europeo de Veolia

Tras la formación impartida a la dirección del comité de empresa europeo de Veolia, IR Share y Astrees formarán hasta junio de 2017 al resto de los miembros del comité por medio de tres bloques formativos de dos días de duración cada uno.

IR Share imparte formación al comité de empresa europeo de Generali por encargo de Sextant

Por encargo de la sociedad consultora Sextant, IR Share ha prestado a los miembros del comité de empresa europeo de Generali soporte y asesoramiento para la adecuación de su nuevo convenio a las disposiciones contenidas en la Directiva 2009/38/CE relativa a los comités de empresa europeos.

IR Share imparte formación para la negociación de convenios al comité de empresa europeo del Grupo Famar

IR Share está trabajando con la dirección del grupo farmacéutico Famar y con la comisión negociadora del grupo para formar a negociadores expertos en legislación comunitaria y relaciones laborales europeas.

IR Share forma a los miembros de la comisión negociadora del Grupo Aperam

El 26 de abril de 2012 IR Share organizó una jornada formativa para la comisión negociadora del Grupo Aperam, compuesta por representantes de los trabajadores a nivel europeo. La jornada contó con la presencia del experto correspondiente de la Federación Europea de Metalúrgicos (FEM).

A study for the European Commission

Anticipation of restructuring

The study conducted by IRshare with Labour Asociados on behalf of the European Commission has produced the following results:

  • European social legislation concerning information and consultation has spawned a certain number of legislative arrangements throughout the European Union which lay the foundation for a policy of anticipating restructuring, permitting advance notification of restructuring projects before they are implemented.
  • Based on this culture born of the rights to information and consultation, the member states have applied more consistent measures as regards how restructuring is managed.
  • On the other hand, only a few member states have developed legislation intended to compel or encourage businesses to anticipate changes at an earlier stage. However, several countries have adopted isolated measures which respond to this concern.
  • What is emerging is therefore a relative harmonisation in the application of the rights to information and consultation and in the social management of restructuring, with a patchwork of measures passed by certain member states tracing a policy of anticipation of restructuring.
  • The legislator's concern with the impact of restructuring on health is still very largely absent. No country has adopted any binding legislation on this subject.
  • The member states are not ensuring that businesses put in place tools for evaluating their practices, in conjunction with the employees' representatives or external organisations, as regards their management of restructuring measures.
